Terms of service
Last updated
These terms apply when you or your organisation use AgentlyDesk: the operator console, the chat widget and the related services. By using them you agree to these terms. If you use AgentlyDesk for an organisation, you confirm that you may accept the terms on its behalf.
Who provides the service
[Legal entity name and registered address — to be provided]
Questions about these terms go to [email protected].
Early access
AgentlyDesk is in early access. We set up workspaces by hand, features may change, and the service may occasionally be interrupted while we improve it. When we plan to remove something you rely on, we will tell workspace owners in advance where we reasonably can.
Your account
- The workspace owner decides who is invited and which role each operator has, and is responsible for what happens in the workspace.
- Each operator keeps their password and second factor to themselves. Accounts are personal and may not be shared.
- Keep the identity key and the webhook key secret, on your server only. If one leaks, revoke it in the console.
- Tell us promptly at [email protected] if you think your workspace has been accessed without permission.
Acceptable use
You may not use AgentlyDesk to:
- send spam, or content that is illegal, deceptive, harassing or infringes someone else's rights;
- distribute malware, or collect passwords or payment details through the chat;
- try to access another workspace, get around limits or bans, or test the service's security without our agreement;
- overload the service or interfere with other customers' use of it.
Your content and your visitors
Conversations, images and other content in your workspace belong to you. You allow us to store and process them only as needed to run the service for you, as described in the privacy policy.
You are responsible for having a lawful basis to collect your visitors' data through the chat and for telling them about it, for example in your own privacy policy.
Plans and payment
The plans and prices are listed on the pricing page. Paid plans are charged per operator, per month. During early access there is no self-serve checkout: we confirm your plan with you before it starts, and nothing is charged without that confirmation. If we change a price, we tell workspace owners before the new price applies to them.
Ending your use
You can stop using AgentlyDesk at any time and ask us to close your workspace. Before it is closed, you can ask for a copy of your conversations. We may suspend or close a workspace that breaks these terms, and will tell the owner why unless the law or the safety of others prevents it.
Security reports
If you find a vulnerability, report it to [email protected] and give us a reasonable time to fix it before sharing it with anyone else. Do not access data that is not yours while testing.
Warranties and liability
We work to keep AgentlyDesk available and secure, but during early access the service is provided as it is, without guarantees of availability or fitness for a particular purpose. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us for the service in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Changes to these terms
When we change these terms we update the date at the top. For changes that matter, we tell workspace owners by e-mail before they take effect. Continuing to use the service after that means you accept the new terms.
